  1. General

1.1 This website, moristravay.mu, is the property of Hospitality Creatives Ltd (Business Reg. No. C20169848) also referred to as “the Company” in the present terms and conditions.

1.2 All Copyright, trademarks or any other intellectual property on this site belongs to Hospitality Creatives Ltd. All users agree not to copy, modify, reproduce, distribute or download any part of moristravay.mu

1.3 These Terms and Conditions supersede all other contracts or agreements. There can be no alteration or variation to these terms and conditions unless expressed in writing by a director of the Company.

  1. Acceptance

2.1 In order to use this website and the Company services, you must agree fully to the present terms and conditions.

2.2 By using this website and any of its services, you agree to adhere and be bound to these terms and conditions. You understand and agree that the Company will treat your use of the website and services as acceptance of the terms and conditions from that point onwards.

2.3 Do not use this website if you do not accept these terms and conditions. The Company reserves the right to revise these terms and conditions at any time.

  1. Service description, account and fees

3.1 The Company provides access to the moristravay.mu website. The website is a job advertising and services website for recruiters to post job adverts or use our services and Jobseekers to post career information and their CV. To access to the job adverts and apply to those, the user has to be a member of moristravay.mu by purchasing a membership.

3.2 Hospitality Creatives Ltd also provide “à la carte” services through moristravay.mu. The services can be purchased without a membership. In order to use the Service, you must create and account according to the rules in section 4.

3.3 Your account is strictly personal. You should not provide your account information, user name and password to anyone else. Should we notice any unusual use concerning your account, the company will terminate your subscription without any refund.

3.4 The company offers free content through the blog and the moristravay.mu website. For the applications and paid services and content. The company uses a third party payment processor to link your credit card to the service. The company is not responsible for any error by the payment processor. This service is provided in order to facilitate access to view and pay Fees online. The company or the Payment Service Provider(s) do not make any representation of any kind, express or implied, as to the operation of the Payment Gateway other than what is specified in the Website for this purpose. By accepting/ agreeing to these Terms and Conditions, the User expressly agrees that his/ her use of the aforesaid online payment Service is entirely at own risk and responsibility of the User.

3.5 The fees linked to memberships may vary according to the commercial offers.

  1. Debit/Credit Card, Bank Account Details

4.1. The User agrees that the debit/credit card details provided by him/ her for use of the aforesaid Service(s) must be correct and accurate and that the User shall not use a debit/ credit card, that is not lawfully owned by him/ her or the use of which is not authorized by the lawful owner thereof. The User further agrees and undertakes to provide correct and valid debit/credit card details.
4.2. The User may pay his/ her fees to the company by using a debit/credit card or through online banking account. The User warrants, agrees and confirms that when he/ she initiates a payment transaction and/or issues an online payment instruction and provides his/ her card / bank details:

  • The User is fully and lawfully entitled to use such credit / debit card, bank account for such transactions;
  • The User is responsible to ensure that the card/ bank account details provided by him/ her are accurate;
  • The User is authorizing debit of the nominated card/ bank account for the payment of fees selected by such User along with the applicable Fees.
  • The User is responsible to ensure sufficient credit is available on the nominated card/ bank account at the time of making the payment to permit the payment of the dues payable or the bill(s) selected by the User inclusive of the applicable Fee.
  1. Responsibilities

5.1 It is your responsibility to ensure all information you provide us in your CV and in relation to your registration information or otherwise is true and accurate; is not abusive, offensive, disruptive, defamatory, and obscene or in any other way illegal; and does not breach the rights of any third party.

5.2 When you have registered using the registration procedure, you shall be responsible for updating the information when it becomes out of date or incorrect.

5.3 You shall indemnify the Company in respect of any losses or liabilities which may be incurred by the Company due to the content of any information or material provided to the Company by you.

5.4 You are responsible for your own dealings with recruiters, employers and agencies and are responsible for the consequences.

5.5 If you provide any information that is inaccurate or incomplete, or we have reason to believe that the information is inaccurate or incomplete, we may suspend or terminate your account and subscription and your use of the service without any refund.

5.6 The Company reserves the right to edit or delete information input on this website and terminate jobseekers’ and members’ registrations with immediate effect at its sole discretion upon any breach of any part of these Terms and Conditions. No rebate payment will be offered or made if this is the case.

5.7 You must be 18 years of age or older to use the service. You represent and warrant that any profile information you submit is true and accurate and that you are 18 years old or older ant are fully able and competent to enter into and abide to the present terms and conditions.

  1. Liabilities

6.1 The Company is not and must not be considered to be an employer. Any employment decisions made through communication via the website shall not be the responsibility of the Company.

6.2 The Company accepts no liability for:

  1. a) Any damage to your software or hardware incurred as a result of using the website, including but not limited to any viruses or cookies
  2. b) Any death or personal injury caused by negligence
  3. c) The availability or inaccuracy of any job posting on the website, or the conduct of any party who places a job posting on the website
  4. d) Any failures in your accessing the moristravay.mu website or any loss or damage which may result from the errors in the operating condition of moristravay.mu website
  5. e) Any loss of information entered into the moristravay.mu website, as it is your responsibility to keep records of all such information.

The Company makes no representations about the accuracy, reliability, completeness, or timeliness of the website or the content. 6.6 Information on this website is supplied in good faith; we are under no obligation to and in general do not directly input the information posted on the website by users of the website. The Company takes no responsibility for the accuracy or nature of information posted on the website. Advertising recruiters have control and sole responsibility for their job advert content on the website.

6.7 The moristravay.mu website is a Job advertising and services website for recruiters to post job adverts or use our services and Jobseekers to post career information and their CV. The Company has no control over the quality, safety or legality of the jobs or CV’s posted the truth or accuracy of the listings, the ability of recruiters to offer job opportunities to job hunters or the ability of Users to fill the Jobs advertised.

6.8 The Company reserves the right to amend or delete any information input on the website at our absolute discretion.

6.9 You agree to indemnify the Company from and against claims, actions or demands resulting from your use of the website or the contents of the website or your breach of the terms of these Terms and Conditions.

6.10 Jobseekers agree that by registering their details with us as with any advertising job site, there may be a possibility that their existing employer may gain access to their information. The Jobseeker agrees to indemnify Hospitality Creatives Ltd against all liability.

6.11 Unless otherwise agreed by the company in writing, the company is not obligated to provide any support for the service.

  1. Intellectual Property

7.1 You hereby undertake to indemnify the Company against any and all liability for any and all copyright infringement or any breach of any other intellectual property right caused by you or your failure to abide by these terms and conditions.

  1. Data Protection

8.1 Hospitality Creatives Ltd shall endeavor to ensure that it operates within the terms of the Act at all times.

  1. Representation

9.1 Failure to adhere or comply with any single element of these terms and conditions or of any rights hereunder by either party shall not release the other from the requirement to fully perform the remaining terms.

  1. Refund and cancellation

10.1 Once the User will be registered and paid the Fee through online Payment Gateway. He/She will not be able to cancel the transaction in any circumstances. No Payment will be refunded to the User.

10.2 In the event there is any claim for/ of charge back by the User for any reason whatsoever, such User shall immediately approach the company with his/ her claim details and claim refund from the company alone. Such refund (if any) shall be affected only by the company via payment gateway or any other means as the company deems appropriate. No claims for refund/ charge back shall be made by any User to the Payment Service Provider(s) and in the event such claim is made it shall not be entertained.

10.3 The User shall directly contact the company for any fraudulent transaction(s) on account of misuse of Card/ Bank details by a fraudulent individual/party and such issues shall be suitably addressed by the company alone in line with their policies and rules.

  1. Governance

11.1 These Terms and Conditions shall be interpreted in accordance with Mauritian law and the Mauritian courts shall decide all disputes.
